CONSCIALINK is a platform where people can have easy and safe access to alternative and holistic wellness practitioners. Encouraging and supporting people to get personalised ‘help’ from different sectors, Conscialink has been designed to act as intermediary and bring together you, as alternative and holistic wellness practitioners and people seeking your offerings.  We aim to be as transparent as possible as to provide you the best experience when making your own selection.

1. General

  1. Please read these Terms and Conditions (‘’Terms’’) carefully. These Terms constitute a legally binding agreement between you and CONSCIALINK LIMITED (hereinafter the “Company”). The Company is duly registered in accordance with the laws of the Republic of Cyprus under registration number ΗΕ 416041.
  2. By accessing this website www.conscialink.com (hereinafter referred to as the “Website”), the Conscialink mobile application (Apple Store and Google Play) (hereinafter referred to as the “Application” or “App”) and the related websites, offerings, applications or tools (collectively referred to as “Conscialink”; us”; “we”; “our” or the “Sites”), you agree to these Terms which are designed to ensure that the platform works for everyone, and are bound by them.
  3. The present Terms and Conditions apply only to practitioners.   Accounts and every Practitioner (as defined below) is subject to them. These terms apply to the use of Conscialink’s Sites by you as a Practitioner, your offerings and the operation of your account. For the avoidance of any doubt, the use of the end-users’ account is subject to separate and different terms and conditions.
  4. You need to ensure that you have familiarised yourself with these terms prior to using Conscialink’s Sites. By entering our Sites, you acknowledge that you understand and agree to be bound by these terms. If you have any questions about these terms or Conscialink, please contact us directly.
  5. We may change these terms from time to time and at any time by posting the amended terms on our Sites. All changes will become effective after 15 (fifteen) days from the date that they are posted and shall be deemed to have been accepted by all Practitioners of our Sites. You are under the obligation to read and accept the Terms and Conditions prior to proceeding. If you do not agree to these Terms of Use, you must not use our Sites.
  6. Your use of our Sites is also subject to the Privacy Policy and Cookies Policy.

2. Interpretation

  1. Any reference to “Users”, shall mean any user and/or visitor of the Conscialink application who might be interested in the platform, material, information, offerings and products provided through the Conscialink.
  2. Any reference to “Practitioner(s)”; “You”; “you”; “your” shall mean any alternative wellness and holistic wellness practitioners and facilitators who offer their Offerings through the Conscialink platform.
  3. Any reference to “Offering(s)” shall mean the workshops, events, and any other type of services that the Practitioners offer to Conscialink Users, in-person, online, live, pre-recorded, or in any type of way that an Offering can be served.

3. How Conscialink works – Account and Subscription Terms

  1. To access our offerings, you must open a Practitioner Conscialink Account. You may use the Conscialink Platform to list your desired offerings and make them available to the Platform (the “Platform”).
  2. For the creation of an account, you need to insert your full name, username, password, email, date of birth, phone number, your card’s details when receiving money for a service, country of residence, sector of expertise, if applicable information as to your degree/certification and a picture of it, registration/ license certificate and number, sufficient proof of having the right to be exercising your profession in the relevant country, official national identity card or international passport or driving license.
  3. Subject to Section 21 below, you acknowledge that your ability to access and use the Platform is conditioned upon the truthfulness of the information you provide regarding your identity and any and all information related to your expertise (including, but not limited to, degree/certification, registration/license number).
  4. Practitioner’s’ Conscialink accounts are subject to a monthly fee upon the expiration of a  1 (one) month free trial. The subject one month free trial could be extended if a valid referral code is applied.
    1. Practitioners can use the referral code during their Practitioner Application process, and receive a discount on their subscription and/or extra free trial period. Practitioners should check with Conscialink for their eligibility.
  5. The practitioners have to pay a monthly subscription fee to access the Practitioner Profile benefits, which will start after their free trial, and the amount is subject to change.
  6. Your account may only be used by 1 (one) individual and the maximum people that are allowed to use a single profile is 1 (one).
  7. You are asked to list all relevant information as to your profession, expertise and offerings as to enable the user to make an informed and fully responsible decision. To minimize the risks, Users are able to report their experience to us if something suspicious comes to their attention. We will evaluate every report along with the justifications provided.
  8. Conscialink shall not be liable for any consequences of the offerings that you are offering including, but not limited to, their quality, effectiveness, efficiency, satisfaction, accuracy, suitability, safety and effects on health whether they are positive or negative to the extent of death.

4. Practitioner Offerings

  1. The list of offerings as these are provided by the Practitioners through Conscialink (collectively referred to as the “Offerings”) is accessible here.
  2. You, as alternative and holistic wellness practitioners can promote your offerings through the Conscialink Platform acting as independent contractors.  You are not employed by Conscialink. Conscialink only provides you the platform acting as online intermediation service provider. Each of you, as contractor must apply all reasonable measures and shall be responsible for your offerings.
  3. The Conscialink Platform lists the identity and offerings as these are provided by Practitioners.
  4. The availability of your offerings shall depend on whether the User is at a geolocation where there is not a big gap with your time zone.
  5. You can list specific Offerings that will only be available to be purchased by Users who wish to use their free-trial credits which are provided to them during their sign-up process.
  6. You must hold a valid certification/license/degree/accreditation evidencing that you are recognised and authorised in the country/countries to provide your offerings if applicable.  You need to be properly qualified to provide the offerings that you list.
  7. You need to be as transparent as possible in order to enable the Users to make their own responsible decision. You have to provide as many details as possible as to help users reach a completed, objective and informed decision when choosing your offerings. Your actions must be in line with the purpose of the application and Conscialink does not encourage or induce the users to use your offerings in any way. Conscialink will autogenerate which offerings are shown first, to Users, in accordance with the information you have provided and in accordance to the information they have provided regarding what they are interested in.
  8. Conscialink does not endorse any advice of any Practitioner and does not assume any responsibility for the quality of Practitioner Offerings.  
  9. It is your exclusive responsibility, when identifying a situation which is outside your abilities and/or expertise, to refer such Users to relevant appropriate Practitioners or, in emergency situations, including but not limited to, serious medical cases, or other medical emergencies, to urge such Users to seek conventional medical advice as provided by the government-recognized healthcare system of the country they are in. Where there are indications of suicidal tendencies or that a User may be in danger or may be a danger to others you agree to call the relevant emergency service number, notify the relevant authorities and urge them to seek immediate in person assistance, subject to the applicable professional code of conduct.
  10. If you fail, omit or neglect to take action as per section 4.7 and 4.9, you will be liable for any and all consequences of your failure, omission or neglect. Such failure, omission or neglect may also result in the suspension or termination of your account.  This section is subject to the professional code of conduct, professionally regulating each Practitioner.
  11. Practitioners should obtain from Users ‘’Emergency Contact Information’’ (name and telephone number) of the User’s personal contact and/or close family member/relation, subject to their consent, to be used in case of a mental health crisis or other emergency.
  12. All messages between Practitioners and Users are personal and Conscialink does not have any access to them. Conscialink may only gain access where a message is reported, in which case the reported message as well as the previous five and following five messages will be sent to Conscialink for the purpose of investigating the reported issue.

5. Information available for each Practitioner

  1. You will be requested to provide information which will be clearly visible to the User. This includes your business identity, your photo, the offerings that are offered, age restriction to receive the Offering if applicable, a brief description of the offerings that you are offering, your place of business/location, years of experience if you wish to be stated, any awards or recognitions and whether group bookings are available.
  2. To ensure satisfaction, you need to provide an accurate and detailed description of the service in order to prevent any disappointments or dissatisfactions by the Users subject to valid reasons to be assessed by Conscialink. At all times, Users may also view the reviews of the Practitioners as these are posted from Users who have previously used your offerings.
  3. The Practitioner Offerings are algorithmically suggested to Users and such suggestions are auto-generated based on the User’s interactions on the Platform and questionnaire answers.

6. Messages, Bookings and Reviews

  1. If the User is interested in a particular service, and has questions, they can contact you by sending a private message for the offerings that are offered.
  2. Through the particular feature, you and the User can discuss about booking a session and the User can request further details for the service. You will be informed once the User has booked the service and you will be informed about the booked date, time, service and place or method.    Users are able to directly book and pay using the Practitioner’s availability timetable.
  3. If the Practitioner provides multiple methods of providing an offering, Conscialink will allow Users to select whether they prefer to have the meeting in person or online. If the User chooses to have the meeting in person, a specific location can be pre-selected by the Practitioner. In case where the User selects to have the meeting online, the platform provides the user the option to hold the session through Zoom or Google meet. For a session via Zoom or Google meet, Conscialink will request your email address and that of the User.
  4. You should acknowledge that every End-user that has used a service from you, can leave a review of their experience. The review can be anonymous or transparent. With the anonymous option, the Users’ name will not be shown, whereby with the transparent option, only their pre-selected username will be shown.  They can give a brief description, write their personal experience with you and post their feedback. The option of writing a review for a Practitioner is only available to Users who have personally purchased and experienced the Practitioner’s Offering, through the Conscialink application . Conscialink aims to keep a safe balance between the reviews and Practitioners and we do our best to exclude any external motives, factors or unfairness.
  5. If Conscialink has reasonable reasons to believe that a review is defamatory and/or valid reports have been submitted and examined, it retains the right to remove it.
  6. If Conscialink becomes aware that illegal content is circulated on the platform, it retains the right to remove and/or to disable access to such contents.

7. Payment Policy

  1. Practitioners will need to insert a valid credit card on the  App-store they use in order  to gain access to their Practitioner’s account.
  2. In order to sign up for a Practitioner Account, you have to be assessed by Conscialink. The assessment is based on the validity of the documents, the personal details and the information that has been provided. Once the assessment procedure is finalized, you will be granted a 1 (one) month free trial and with the expiration of the trial, you will be automatically charge for the pre-selected subscription in advance as per Section 3 above. Conscialink offers you the choice to pre-select to subscribe for a monthly subscription, a 6 months subscription or an annual subscription. The price of each subscription shall vary and shall be calculated depending on the duration of subscription.
    1. Your membership will be valid for the pre-selected subscription period and you will have access to your Practitioner account for the selected duration. We do not provide refunds for unused periods of memberships as the amount covers the whole duration of the subscribed period. Please refer to ‘Cancellation and Termination’ section below for more information.
  3. If you cancel your Practitioner account membership, your account will remain in Conscialink’s records but will not be treated as an active Practitioner Account if the duration of your membership has expired. In this case, it will be inactive until the relevant fee has been paid to Conscialink. If you chose to cancel your Practitioner account membership before the duration of your membership expires, you will be able to reactivate your account without any additional cost, before the duration expires. In this case, the normal fee will be charged at the end of your membership duration to keep your membership active.
  4. Conscialink receives a small percentage / standard fee from each transaction made between a User and Practitioner Account. The percentage/fee currently is capped at 5%.
  5. If a transaction fee is imposed on a transaction between the Practitioner and the User, the transaction fee shall be deducted from the Practitioner’s profit.
  6. If a transaction fee is imposed on a transaction between Conscialink and the Practitioner, particularly in the case where Conscialink is sending the money that the Practitioner has earned through Conscialink, then the transaction fee shall be deducted from the Practitioner’s profit.
  7. The money that the Practitioners shall receive for the Offerings they have provided shall be calculated in accordance with the credits that the Users have paid to receive their Offering.
  8. In relation to the amount to be received by Practitioners when eligible for a refund for a booked Offering, the estimated timeframe that the Practitioners shall receive the money they are entitled to depends on the App store that the User used to download Conscialink and who has booked the specific Offering. Each App store applies different timeframes and once Conscialink receives the refunded amount from the particular App store, Conscialink will require at least 7 (seven) business days to send the refunded amount to the Practitioner, after deducting any transaction fees and our standard fee.
  9. In regards to the subscription for the Practitioner’s Account, Conscialink receives the money from the App store that the Practitioner used to download Conscialink within the timeframe set by the particular App store.
  10. For the payment of the Practitioner, Conscialink will provide the payment to the Practitioners within 7 (seven) business days from the date that Conscialink received the payment from the App store. It is noted that each App store applies different timeframes.
  11. The Practitioners are responsible to issue their invoices in Conscialink’s name, including all required information and the services they have already offered to Users. Conscialink after reviewing the services and amount mentioned, shall provide payment to the Practitioner in accordance and as per the conditions set above.

8. Refund Policy

  1. Cancellation
    1. The User will be entitled to a full credit refund if the Practitioner cancels the Offering.
    2. The User will be entitled to a full credit refund if the User sends a cancellation request to Conscialink through the section ‘Contact us’ at least 3 hours before the session.
    3. The User might be entitled to a partial credit refund which shall be examined by Conscialink on a case by case scenario and multiple factors shall be examined including but not limited to, any expenses incurred by the Practitioner for hosting the Offering. Conscialink shall communicate its decision for the refund request via email.
    4. In case the User does not cancel the booked Offering and does not inform Conscialink, the User will not be entitled for any refund.
    5. In case the Offering booked by the User is subject to age restriction and the User has booked the Offering without being eligible, the underaged User that disregards such age restriction imposed by the Practitioner, may be denied access and/or entry to such Offering and in this case shall be entitled to a partial credits refund.
  2. Technical Failure
    1. If there is a technical failure from your end and/or from the user’s end with disconnections or other technical malfunction occurring at 60% or less of the session time, the User will be entitled to partial credit refund . The credit amount to be refunded is at the sole discretion of Conscialink depending on a case-by-case basis. It is clarified that in order for the user to be entitled to such credit refund, the relevant proof for such technical failure, and its duration, must be provided. Please record proof of such technical failure to aid Conscialink in the process of making a final decision regarding the credit refund amount.
  3. Dissatisfaction
    1. If the User is dissatisfied or unhappy with your service, we will evaluate the User’s issue on a case-by-case basis and, at our discretion, take steps to resolve any issue. This includes without limitation to extending and/or issuing partial credit refunds if after careful examination, there are valid reasons for such credit refunds.

9. Internal Complaint-Handling System

  1. In order to ensure your protection on our platform and to ensure a fair examination of each case, we have an internal complaint-handling system available. Your complaint shall be sent to the email [email protected] and through the particular mechanism we will conduct an examination on a case-by-case basis.
  2. All refund request situations mentioned in section 8.3 above, will be assessed based on their individual facts and circumstances. Refunds will only be offered in extraordinary cases, in our discretion, where the user’s claim is based on objectively valid reasons which justify a refund.
  3. You may raise complaints with Conscialink directly regarding any of the following issues:
    • Alleged non-compliance by Conscialink with any obligations under the applicable law which affects you lodging a complaint;
    • Technological issues as per 8.2 that affects you;
    • Measures taken by, or behavior of, Conscialink which relate directly to the provision of the Practitioner Offerings and which can affect you.

10. Cancellation, termination and suspension

  1. The responsibility to stop the monthly, biannually or annual subscription lies with you. Unless the account is cancelled through the Sites, the monthly, biannually or annual subscription is automatically renewed every year for the specified period.  It is solely your responsibility to cancel the monthly, quarterly or annual subscription. The cancellation can be completed through the “My Practitioner Plan” section of the Sites by selecting to cancel your subscription or delete your account. A phone or email request to cancel your account is not considered a valid cancellation.
  2. The Sites do not impose any extra cancellation fee but no refunds will be offered if the account was cancelled before the monthly, annual or biannual termination date except as provided herein.
  3. Conscialink reserves the right to refuse the opening of a Practitioner Account to anyone for any reason at any time.
  4. Conscialink has, in its sole discretion, the right to suspend or terminate your account and refuse any and all current or future use of your account for any reason at any time. Such termination will result in the deactivation or deletion of your account and access to your account, and the forfeiture and relinquishment of all content in your account. In case your account is reported, each case will be considered individually and at Conscialink’s sole discretion.
  5. In case where we conclude to terminate your provision of offerings, we will give you a 30-day notice and an explanation for such decision. You will then have the opportunity to clarify the matter before the expiration of this period. Conscialink has the discretion upon such clarification to revoke the restriction, suspension or termination and to reinstate you.

11. Modifications and Amendments

  1. Conscialink reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, its offerings with or without notice.
  2. We reserve the right to change these terms from time to time. You may receive an email to get notified of any potential updates of the Terms and Conditions. All material changes will be published on our Sites and there will be a 15-day notice before the change is applied.
  3. Conscialink shall not be liable to you or to any third party for any modification, price change, suspension or discontinuation of your account or any Conscialink features or function.

12. Exclusion and Limitation of Liability

  1. You have the full responsibility of the information and advice that you provide to Users and it should not be treated as any kind of inducement, encouragement, psychological, emotional or professional advice by Conscialink. Conscialink is not liable for the content, advice, validity, information, suggestions, encouragement or guidance that you provide and you should not be considered to be an employee of Conscialink. The aim of Conscialink is to provide easy access to you, the alternative wellness practitioners, and your Offerings.
  2. You are advised to be as transparent as possible and have a clear understanding of the Users’ requests.
  3. We accept no liability for any material, information, links, language, hate speech, cat-fishing impersonation whatsoever used through our Sites. We do not give any warranty nor make any representation about any information and/or personal data presented through our Sites.
  4. Conscialink tries to its best of its ability to evaluate the Practitioners’ accounts before they are listed on the platform, regularly checks any reports by the users or Practitioners and regularly checks the feedbacks and reviews that have been posted.  Conscialink does not guarantee that Practitioners selected by the Users will satisfy their needs and expectations. Conscialink makes a proactive effort to ensure the truth and accuracy of the information provided by Practitioners, but we do not guarantee the truth and accuracy of the information provided by Practitioners. More specifically, we assume no responsibility if you were approved as a Practitioner after presenting us with false information. We do our best to verify all certificates to the biggest extent we can and we try to revisit Practitioners certificates periodically to ensure their validity.
  5. We will exercise professional diligence in providing a safe use of our platform, secure and error-free environment. Provided that we have acted with professional diligence, we do not accept responsibility for losses not caused by our breach of these Terms or otherwise by our acts; losses that are not reasonably foreseeable by you and/or us at the time of entering into these Terms; and events beyond our reasonable control.
  6. Conscialink does not represent you. It merely provides you the platform where you, as independent contractor, list your offerings. Conscialink is not your employer and each of you shall be responsible for your actions or omissions. Conscialink shall not be liable for any consequences of the offerings that are offered by you including, but not limited to, its quality, its effectiveness, its efficiency, its satisfaction, its accuracy, its suitability, its safety.
  7. You hereby agree that your decision to list a service on our Site was freely concluded and all relevant information is accurate and true. You agree that Conscialink is not liable for any damages of any kind for any reason arising out of, or related to, acting on information or advice of your listed offerings on the Sites or any consequences arising by maliciously using the messages option on our Sites.
  8. To the maximum extent permitted by applicable law, in no event shall Conscialink, its affiliates and partners be liable under the law of tort (including negligence), contract or otherwise for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including but not limited to damages for personal injury, death, damage to property, loss of use, data or profits, misuse of the system arising out of or in any way connected with the use or performance of the Sites, the performance or non-performance of any of our obligations under these terms or otherwise out of your use of Conscialink, the delay or inability to use the Sites or related offerings, the provision of or failure to provide offerings or for any information, software, products, offerings and related graphics obtained through the site, or otherwise arising out of the use of any site, or otherwise, even if Conscialink or any of its partners have been advised of the possibility of damages. Conscialink, its affiliates and partners accept no liability for any kind of damage or loss arising out of, or in any way connected with the use or performance of the Sites.
  9. If you do not agree with any part of the Sites or with any terms of use, your sole and exclusive remedy is to stop using the application or delete your account.

13. Exceptions to Liability Limitations

Nothing in these terms excludes or limits Conscialink’s (or its affiliated companies’, contractors’, subcontractors’, directors’, officers’, employees’, agents’, third party suppliers’ or licensors’) liability to the extent that it cannot be excluded or limited by applicable law.  

14. No Prejudice to Consumer Law  

Users, as consumers, may benefit from any mandatory provisions of the law of the country in which they are residents. Nothing in these terms and conditions, affect their rights as consumers to rely on such mandatory provisions of local law.

15. Our Intellectual Property

  1. We own, control or have the right to use and provide the Sites and all content on or from these such as data, text, images, articles, photographs and illustrations.
  2. Conscialink owns and has trademarked both the name and the logo in all countries of the world. You may not use the name “Conscialink”, “CL” “Conscialink”, “Conscialink” or its logo in any color for any use.
  3. Conscialink’s offerings, content, visual interfaces, information, graphics, design, compilation, computer code, products, software, offerings, including the mobile device applications, and all other elements of the Conscialink’s offerings (collectively, the “Materials”) are protected by the United States, United Kingdom, Canada, Europe and Australia copyright, patent, trademark laws, international laws and conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. All materials contained in Conscialink are the property of Conscialink or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names displayed on Conscialink are proprietary to Conscialink or its affiliates and/or third-party licensors. Except as expressly authorized by Conscialink under this Agreement, You agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise use the Materials.
  4. You may not display or distribute the content of any part of the Sites or its content with any third-party or in public, including any reproduction in any form on the Internet, without our express permission.
  5. Any infringement of our intellectual property rights will be fully enforced under Cyprus law.

16. Your information

  1. Your information includes without limitation the personal information as described in section 3.2. above.
  2. You may at any time make a written request to see any personal information that we hold or to ask us to correct any mistakes in that information.
  3. Your information is protected by our Privacy Policy.
  4. We do our best to assess every Practitioner who uses our Sites before your profile is listed on the Platform. We apply every method available to us in order to minimise any risks and to discourage any misrepresentation, misleading information and/or any kind of improper conduct.
  5. Conscialink does not accept any claims for loss as to the information and/or data that you have provided in the operations of our Sites.
  6. Use Outside Cyprus: The Conscialink’s offerings are controlled and offered by Conscialink from Cyprus and, regardless of your place of residence or your use of them, they are governed by the law of Cyprus.
  7. Conscialink makes no promotion or representations that the Practitioner Offerings are appropriate or valid to be received in other countries or are legal in all jurisdictions. For both, a regulated or unregulated profession, every Practitioner must have the appropriate license/ issued by the relevant competent authority to provide the particular service and/or have the professional qualification recognized in the country you wish to offer your offerings. It is your responsibility to ensure that you comply with the relevant requirements and to follow the obligatory procedure to offer the respective offerings in the respective country.
  8. Those of you who access, use or are listed on the Sites from other countries are doing so at your own risk and are responsible for compliance with local law. You consent to transfer and processing of Your data in Cyprus and any other jurisdiction throughout the world. Please see our Privacy Policy for more information on how we temporarily store, use and transfer your data.

17. E-mail policy

  1. This demonstrates our firm commitment to your privacy and the protection of your information.

    If you received an email from us your email address is listed with us either:
    1. As someone who has expressly shared this address for the purpose of receiving information from us, or;
    2. You have created an account with us or;
    3. You have breached these Terms or any of our policies.
  2. Each email we send you contains an easy, automated way for you to unsubscribe from our mailings. To unsubscribe simply follow the instructions at the end of any email. You will never be emailed again. (Note: We retain the right to email you in the case of critically important information. For example, our system is about to change in a way that may cancel your actively used account. We assume you’d like to know about information as important as this. We expect this type of email will be few and far between, if ever.)

18. Ranking and Differentiated Treatment

  1. As specialists from the holistic and alternative wellness field who are not subject to prior authorisation or supervision of any bodies setting standards and regulations for your practices, we provide the users the title of the alternative and holistic expertise a practitioner has.
  2. Based on the answers the User selected during the sign-up process, the User will view the relevant Practitioners who will be ranked based on the answers the User provided and the reviews already assigned to the Practitioner.
  3. As per Section 7.5 Conscialink receives a small percentage / standard fee from each transaction made between a user and Practitioner Account. A fixed fee 5% applies per transaction.

19. Our responsibilities

  1. We will provide access to Conscialink and do our best to ensure that the Sites operate reliably and consistently. We do not guarantee however that they will operate uninterrupted without any faults. To ensure your satisfaction, we regulate situations when there is a technical failure from the user’s or your end and/or for disconnections.
  2. We are not responsible for any losses suffered by you as a result of: any interruption of Conscialink however caused; hacking or cyber-attack of the Sites; suspension or termination of your access to the Sites or cancellation of your account; your use of the Sites.

20. Your responsibilities

  1. Access to your account is granted by your designated username and password. You may change your password at any time.
  2. You are responsible for ensuring that no unauthorised access is obtained through your account. You will be exclusively liable for all activities conducted through your account whether or not authorised by you, until the time we are notified of such unauthorised use.
  3. If we have reason to believe that you are breaching the security or you are misusing the Sites, we may suspend your account without notice.
  4. Conscialink also provides you the facility to report any Conscialink user. Conscialink will investigate and will at its sole discretion and upon reasonable cause decide whether the reported account holder is in breach of any of the Terms and Conditions.
  5. You may not create alternate accounts for any purpose whatsoever. In case Conscialink suspects the creation of such alternate accounts, it reserves the right at its sole discretion to terminate any of your active account without any notification to you.    

21. General responsibilities

  1. We try to make Conscialink broadly available to everyone, but you cannot use Conscialink if:
    • you are under 18 years old;
    • we have previously disabled your account for breaches of our Terms or Policies;
    • you are prohibited from listing your offerings or software under applicable laws;
    • If you do not possess the relevant certification/license/degree/accreditation when providing a service;
    • If your license/certificate/qualification/degree/accreditation is not recognized in the country that you provide the service.
  2. We provide these offerings to you and others to help advance our mission. In exchange, we need you to make the following commitments.
  3. You are responsible for:
    • ensuring that all information you provide to us, is correct and complete;
    • ensuring that all documents you provide to us, are clear, true and valid;
    • ensuring that your actions are in line with the purpose of the application;
    • ensuring that your use of the Sites and the offerings is lawful;
    • complying with these terms, and any of our policies relating to your use of the Sites;
    • complying with all other lawful requirements relevant to your use of the Sites;
    • keeping us informed of any changes to your contact details.
  4. Your ability to access and use the Platform is conditioned upon the truthfulness of the information you provide regarding your identity and any and all information related to your expertise (including, but not limited to, degree/certification, registration/license number). You have an obligation to inform us immediately of any changes to your ability to provide offerings including but not limited to the loss of your license.
  5. You agree to use Conscialink only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of Conscialink. Prohibited behaviours include but are not limited to acting unprofessional, making false statements and representations or disrupting the transparency of the application.
  6. You agree to keep the personal information of Users accessing your offerings confidential and maintaining their privacy at all times subject to any life and health threatening situations as per Section 4.7.
  7. We want people to use Conscialink as an easy access to practitioners who can help people nourish their wellbeing, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so).
  8. You may not use our offerings to do or share anything:
    • In any way that breaches these Terms of Use or any applicable law or regulation.
    • In any way that is unlawful or fraudulent, or which has any unlawful or fraudulent purpose or effect.
    • To send, knowingly receive, download, use or re-use any material for any commercial purpose or in a manner which does not comply with our content standards (as set out below).
    • To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar request (commonly known as ‘spam’).
    • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
    • To use the feature of messaging the user to send or share any defamatory or illegal material of any nature. This includes text, graphics, video, programs or audio. Contributing materials with the intention of committing or promoting an illegal act is strictly prohibited.
    • To spread false or inaccurate information through messages intentionally or unintentionally.   

    22. Indemnity

    You agree to indemnify, defend and hold harmless Conscialink and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

    23. Accuracy of Content and Information

    1. Conscialink contains content generated by us. The content displayed on the Sites is provided for general information purposes only.  It is not set up to provide specific advice on which you should rely on.
    2. If any links to other websites appear on Conscialink, we accept no responsibility or liability for the content of that website (whether under our control or otherwise). Conscialink does not promote the clicking of links presented in the app as we cannot verify their safety. Any link in the Platform is not intended to be, nor should be construed as, an endorsement of any kind by us.
    3. The information contained in Conscialink may contain technical inaccuracies, typographical errors or omissions.  We reserve the right to correct any errors, misinformation, inaccuracies or omissions, and to change or update information in Conscialink or on any related site if it is inaccurate at any time without prior notice. But we are not liable to any errors, inaccuracies or omissions presented in the Sites. We undertake no obligation to update, amend or clarify information in Conscialink except as required by law.
    4. Information contained in or accessible via the Sites, changes on a regular basis.  We reserve the right to make changes and improvements to any information contained within Conscialink, at any time and without notice.
    5. Although we make reasonable efforts to update the information on the Sites, we make no representations, warranties or guarantees, whether express or implied, that such content is accurate, complete or up-to-date. We also do not warrant or represent that the information or materials available through the Sites will meet your particular requirements or needs or that access to, or use of, the same will be uninterrupted.

    24. Breach of Terms – Suspension – Termination of Access to Conscialink

    1. We reserve the right to terminate, suspend or restrict your access to Conscialink in case you are found to be in breach of these terms.
    2. You further acknowledge that we may terminate, suspend or restrict your access to the Sites at any time at our absolute discretion subject to section 9.

    25. Complaints and Communication

    1.  If you have a complaint relating to Conscialink, you should contact us on [email protected]  or visit the “Contact Us” section that can be found in the Website and the Application.
    2. We aim to provide a written response to all complaints sent via email within 20 (twenty) business days while complaints submitted through the ‘Contact us’ section shall be responded rapidly.
    3. If you believe that illegal content is circulated on the platform you can notify us on [email protected] . You are requested to include an explanation of the reasons you believe it is illegal content, provide clear exact electronic location that this illegal content can be traced, your full details and email address and a statement confirming your bona fide belief.
    4. Our point of contact for communication and for a transparent and safe online environment shall be the email [email protected] and the English language shall be used.
    5. You can contact us at [email protected] if you have a question and/or need guidance directly and rapidly. We will do our best to assist you rapidly and effectively.

    26. Entire agreement

    These terms (including any terms or policies explicitly incorporated by reference) amount to the whole arrangement between you and us relating to your use of our offerings. These terms replace any prior related agreements and understandings between you and us.

    27. No waiver

    No delay, neglect or forbearance in taking enforcement action in relation to any provision of these terms by Conscialink will be a waiver, or in any way prejudice any right, of that party.

    28. Severability

    If any part of these terms is held to be invalid, illegal or unenforceable, that part will be severed and the remainder of these terms will remain in full force and have full effect.

    29. Subcontracting

    We may subcontract to any third party all or part of our rights and obligations under these terms.

    30. Jurisdiction

    1. These terms are governed by Cyprus law and any legal action against us must be taken in a Court in Cyprus.
    2. If you or any third parties’ access Conscialink from outside Cyprus, this is done at your own risk and you are responsible for complying with the laws in the place where you access Conscialink.
    3. Regardless of our place of residency, your use of Conscialink is governed by the law of Cyprus. We make no representations that the offerings provided through Conscialink are appropriate for use in other locations or are legal in all jurisdictions. If you access or use the Sites from other locations do so at your own risk and you are responsible for compliance with local law.
    4. By entering into this Agreement or otherwise, Conscialink does not consent to the jurisdiction of any courts other than Cyprus courts and reserves the right to contest that it is not subject to the jurisdiction of any other court.

    31. Notices

    1. We will send relevant invoices, receipts, responses to a query and notices, if and as required under these terms to the email address nominated by you. The app stores are responsible for the invoices that arise from the purchase of credits and the purchases of the Practitioner Account memberships.
    2. It is your responsibility to ensure that you keep us informed of any changes to your contact details, criminal record, any change to your certification/license/degree/accreditation and any change to the recognition of right to be exercising the relevant Profession in the respective country. You will be deemed to have received a notice sent by email at the time that we send it.

    32. Mediators

    For any dispute between Conscialink and Practitioners which arises in relation to the provision of offerings through the platform, we will coordinate with an authorised mediator, as appointed at Conscialink’s discretion, in order to reach an agreement with Practitioners out of court. This will only be available for issues that have not been resolved through the internal complaint-handling system.
